在本文博弈分析过程中未考虑监理工程师的行为及道德风险,监理的个人素质和追求利益最大化也可能对索赔结果产生极大地影响。
摘要:近几年来,随着建设项目的增多,工程施工索赔也越来越频繁,其金额也日益增长。
即使大多数承包商都意识到索赔是工程管理中一个重要的环节,但是由于经验的缺乏使得承包商不敢索赔,不会索赔又或是被业主反索赔,这种种的现象表明建设工程承包商施工索赔管理的研究迫在眉睫。
本文首先提出全过程索赔管理的的概念,从合同订立和合同实施两阶段尝试性建立索赔管理框架,运用博弈论建模分析施工索赔过程中业主和承包商的行为,得出影响承包商索赔策略选择的重要因素,并且提供了承包商在各种情况下的最优索赔策略选择。最后,本文通过案例,结合全过程索赔管理的思想,证明了科学合理的策略选择对于保障承包商利益的重要性。

Study on Contractor's Claim Management in Construction Project
Abstract:In recent years, with the increasing of the construction project, the number of engineering construction claims become more and more frequent and the amount of money have increasing sharply. Although most of the constructors can realize the importance of the claim, engineering construction claim is still a weak part in our country. In practice, the contractors have no dear to claim, have no idea to claim and even be claimed by the owner, which caused the low efficiency of the claim. All these reasons makes the search of the engineering construction claim in construction project of the contractor become urgent.
Firstly, the paper mentioned the concept of the whole claim management, the basic framework are tried to built from two links including conclusion of contracts and Contract implementation, connecting the concept of PDCA and the Game Theory, using the game theory model analysis of construction claim the owners and contractors' behavior in the process, it is concluded that the contractor litigation costs, the probability of success, the claim amount and proportion of the landlord compensation, litigation costs are the important factors that affect the contractor claim strategy selection, and provides various cases, the contractor claim optimal strategy choice.Finally, through the case study, this paper analyzes the whole process of the claim management, demonstrates the scientific and reasonable strategic choice, and the importance of protecting the interests of the contractor and the success of the claim.
